Pfizer’s patent for the drug contains the key ingredient, sildenafil, which Pfizer was granted exclusive rights to manufacture and market the drug in the United States, under thePatent Act.
Sildenafil is the active ingredient in Viagra and Pfizer’s patent on the drug expired in November 2017, so that sildenafil cannot be sold on the market without the supervision of a licensed healthcare professional. However, if a new drug is developed with sildenafil, it will be available on the market without patent protection in the United States.
In December 2017, the U. Food and Drug Administration (FDA) approved a drug calledSildenafil (Viagra) Connect, an oral tabletand a treatment for erectile dysfunction (ED).

The patent on Sildenafil was valid until April 2020. It was invalid for a number of reasons, including a lack of rigour in the patent application process.
In April 2020, the FDA issued a warning letter about the lack of rigour in the patent application process because the patent had not yet expired.
In August 2017, Pfizer issued a notice to all patients with erectile dysfunction, including those who were taking nitrates or nitroglycerine for heart failure.
If a new drug is developed with sildenafil, it will be available on the market without patent protection in the United States.
